Attorney General James Announces $85 Million Multistate Settlement with Honda Over Airbag Failures
In the complaint, the states alleged that Honda engineers suspected that the airbags’ propellant (ammonium nitrate) could burn aggressively and cause the inflator to burst.
Honda also agreed to pay the participating 48 attorneys general a total of $85 million in fines, of which New York’s share is $3,385,945.
The states specifically allege that Honda’s actions — or its failures to act — as well as its misrepresentations about the safety of its vehicles, were unfair and deceptive, and that Honda’s conduct violated state consumer protection laws, including New York’s Executive Law § 63(12) and New York General Business Law § 349.
Today’s settlement will not only guarantee Honda replaces all remaining defective airbags on the road, but that the company takes specific actions to ensure any future defect is thoroughly made public in the future to avoid this type of danger.”

SACRAMENTO – California Attorney General Xavier Becerra today announced an $11.375 million settlement against American Honda Motor Company, Inc. and Honda of America Mfg., Inc. (together, "Honda") related to allegations that the company concealed safety issues associated with defects in the frontal airbag systems designed and manufactured by Takata Corporation that were installed in certain Honda and Acura vehicles sold in the United States.
To date, Honda has recalled approximately 12.9 million Honda and Acura vehicles equipped with the defective airbags.
While Takata allegedly concealed the risks of its airbags' safety from Honda, the investigation revealed Honda engineers suspected Takata's airbags posed a significant risk of rupture by no later than July 2009.

Although the DeSilvia Plaintiffs added additional allegations in the Second Amended Consolidated Class Action Complaint related to their research on the vehicle they purchased, Honda argues that the claim still fails because “[a] statement that is true and does not create a false impression is not actionable under the ICFA,” and the DeSilvia Plaintiffs have failed to point to any statement they received that was untrue or misleading.

In addition, Honda allegedly continued to represent to consumers that its vehicles – including the airbags – were safe.
Today’s settlement resolves allegations that Honda’s conduct regarding the faulty airbags, its failures to act, and its concealment of the problem – as well as its misrepresentations about the safety of its vehicles – violated consumer protection laws in the participating jurisdictions.
