Attorney General James Announces $85 Million Multistate Settlement with Honda Over Airbag Failures
In the complaint, the states alleged that Honda engineers suspected that the airbags’ propellant (ammonium nitrate) could burn aggressively and cause the inflator to burst.
Honda also agreed to pay the participating 48 attorneys general a total of $85 million in fines, of which New York’s share is $3,385,945.
The states specifically allege that Honda’s actions — or its failures to act — as well as its misrepresentations about the safety of its vehicles, were unfair and deceptive, and that Honda’s conduct violated state consumer protection laws, including New York’s Executive Law § 63(12) and New York General Business Law § 349.
Today’s settlement will not only guarantee Honda replaces all remaining defective airbags on the road, but that the company takes specific actions to ensure any future defect is thoroughly made public in the future to avoid this type of danger.”

SACRAMENTO – California Attorney General Xavier Becerra today announced an $11.375 million settlement against American Honda Motor Company, Inc. and Honda of America Mfg., Inc. (together, "Honda") related to allegations that the company concealed safety issues associated with defects in the frontal airbag systems designed and manufactured by Takata Corporation that were installed in certain Honda and Acura vehicles sold in the United States.
To date, Honda has recalled approximately 12.9 million Honda and Acura vehicles equipped with the defective airbags.
While Takata allegedly concealed the risks of its airbags' safety from Honda, the investigation revealed Honda engineers suspected Takata's airbags posed a significant risk of rupture by no later than July 2009.

Although the DeSilvia Plaintiffs added additional allegations in the Second Amended Consolidated Class Action Complaint related to their research on the vehicle they purchased, Honda argues that the claim still fails because “[a] statement that is true and does not create a false impression is not actionable under the ICFA,” and the DeSilvia Plaintiffs have failed to point to any statement they received that was untrue or misleading.

In addition, Honda allegedly continued to represent to consumers that its vehicles – including the airbags – were safe.
Today’s settlement resolves allegations that Honda’s conduct regarding the faulty airbags, its failures to act, and its concealment of the problem – as well as its misrepresentations about the safety of its vehicles – violated consumer protection laws in the participating jurisdictions.

As part of the settlement with Honda, the CPPA authorized its enforcement division to impose administrative fines of up to $2,500 on the automaker for each data privacy violation and a fine of $7,500 for intentionally collecting sensitive data from customers.

The agency alleges that Honda violated Californians’ privacy rights, in part, by requiring Californians to provide “excessive” personal information in order to opt out of the sale or sharing of data; and by sharing consumers’ personal information with ad tech companies without producing contracts that contain the necessary terms to protect privacy.
This week, the agency issued a $632,500 fine against American Honda Motor Company as part of the agency’s first investigation since it gained enforcement powers in 2023.
Californians are legally entitled to opt out of the sale and sharing of their personal data, but Honda was making that too difficult, according to the California Privacy Protection Agency, which was established in 2020 when voters approved the California Privacy Rights Act.

On January 17, 2025, the Bureau issued an order against American Honda Finance Corporation (Honda Finance) to address its violations relating to its furnishing of inaccurate consumer reporting information.
The Bureau also found that Honda Finance violated FCRA and its implementing Regulation V by continuing to furnish inaccurate and incomplete information after it determined the information was incomplete or inaccurate; failing to timely complete indirect dispute investigations and report the results of the investigations to CRAs; failing to establish and implement reasonable written policies and procedures regarding the accuracy and integrity of the information it furnished to CRAs; and failing to conduct reasonable investigations of direct disputes and timely report the results to consumers.
The Bureau found that, during the COVID-19 crisis, Honda Finance allowed consumers to defer payments and promised to continue reporting those consumers to the consumer reporting agencies (CRAs) as current, but instead, reported those consumers as delinquent when they did not make payments during the deferral period, in violation of the Fair Credit Reporting Act (FCRA).
